1. Acceptance of Terms

By creating an account or using Novantis, you agree to these Terms of Service. If you do not agree, do not use Novantis. You must be at least 18 years old to use this service.

2. Not Legal Advice

Novantis provides document preparation assistance, not legal advice. The documents generated by Novantis are based on templates and the information you provide. Novantis is not a law firm, and no attorney-client relationship is created by using Novantis. For advice specific to your legal situation, consult a licensed attorney in your state.

Laws vary by state and change frequently. While Novantis monitors legal changes and alerts you to material updates, we cannot guarantee that every document will be valid under the law in effect at the time of execution or at the time it is used. You are responsible for having documents reviewed by an attorney if your situation is complex.

3. Eligibility

  • You must be at least 18 years old.
  • You must have legal capacity to enter into contracts.
  • You must be a U.S. resident. Novantis generates documents under U.S. state law only.

4. Your Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity under your account. Notify us immediately at support@novantis.com if you suspect unauthorized access. We are not liable for losses from unauthorized access resulting from your failure to maintain account security.

5. Payments and Refunds

Payments are processed by Stripe. You agree to pay all fees at the time of purchase. All sales are final. We do not offer refunds except where required by law or at our sole discretion in cases of documented technical failure preventing document delivery.

Annual memberships renew automatically each year. You may cancel auto-renewal at any time in your account settings. Cancellation takes effect at the end of the current billing period.

6. Our Guarantee

If a document we generate contains an error that causes it to be declared invalid by a court in your state, and the error was caused by a defect in our templates (not by information you provided incorrectly), we will regenerate the corrected document at no charge. This guarantee does not cover errors in information you provided, changes in law after document generation, or improper execution of the document.

7. Executor Access

When you invite an executor to access your documents, you are granting them limited access to view specific documents you designate. You are responsible for selecting appropriate executors and for the consequences of granting access to others.

8. Acceptable Use

You agree not to:

  • Use Novantis to create documents for someone other than yourself without their authorization
  • Provide false information in your estate planning session
  • Attempt to reverse engineer, scrape, or circumvent our systems
  • Use Novantis for any unlawful purpose

9. Limitation of Liability

To the fullest extent permitted by law, Novantis's total liability to you for any claims arising from use of our services shall not exceed the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special, or consequential damages.

10. Governing Law

These terms are governed by the laws of the State of Delaware. Any disputes shall be resolved through binding arbitration administered by JAMS under their Streamlined Arbitration Rules. You waive any right to participate in class action lawsuits or class-wide arbitration.

11. Changes to Terms

We may modify these terms at any time. We will provide at least 30 days' notice by email before material changes take effect. Continued use after the effective date constitutes acceptance of the revised terms.
